These Terms of Use ("Terms") govern your use of Kinnect’s platform, and associated services (excluding the Kinnect Community Manager Portal, which is governed by the EULA) ("Services"). By using Kinnect, you consent to the data practices described in this Privacy Policy. If you do not agree with this policy, you should discontinue use of our Services.

1. Eligibility & Account Registration

1.1 Eligibility: You must be at least 16 years old to use Kinnect. By registering, you confirm that you meet this requirement.

1.2 Account Responsibility: You are responsible for maintaining the confidentiality of your login credentials. Any activities occurring under your account are your responsibility.

1.3 Accuracy of Information: You must provide accurate, up-to-date information when creating an account. Kinnect is not responsible for any issues arising from incorrect account details.

  • Violate any applicable laws, intellectual property rights, or third-party rights.
  • Distribute malicious software, spam, or unauthorised advertisements.
  • Harass, abuse, or threaten others.

2.2 Community Standards: Users must follow Kinnect’s Community Standards and Content Guidelines (linked separately), which outline appropriate behaviour and content moderation policies.

Kinnect reserves the right to remove, restrict, or moderate user-generated content that violates these Terms or our Community Standards.

3.2 Data Privacy: Your use of Kinnect is subject to our Privacy Policy and Data Protection Agreement (DPA), which explain how we collect, process, and share data.

3.3 Community Manager Data Access: Community Creators manage and moderate their communities on Kinnect. However, they do not have access to advanced analytics or user data export unless they upgrade to the Community Manager Portal, which is governed separately under the EULA.

4. Termination & Account Suspension

4.1 By Kinnect: We may suspend or terminate your account if you violate these Terms, engage in illegal activities, or misuse our Services.

4.2 By User: You may terminate your account at any time by discontinuing use of Kinnect. No refunds will be provided for unused subscription time.

4.3 Effect of Termination: Upon termination, you must cease all use of the Services. Certain obligations, including data privacy commitments, may survive termination.

5. Limitation of Liability, Disclaimers, Service Availability, & Third-Party Services

5.1 No Warranties: Kinnect is provided “as is” without any warranties, express or implied. We do not guarantee uninterrupted or error-free access to our Services. Kinnect reserves the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice. Kinnect is not liable for the removal of any features, tools, or functionalities, and no compensation or refunds will be provided for such changes.

5.2 Limitation of Liability: To the maximum extent permitted by law, Kinnect is not liable for indirect, incidental, or consequential damages arising from your use of our Services.

5.3 Indemnification: You agree to indemnify Kinnect against any claims, damages, or liabilities resulting from your use of our Services or violation of these Terms.

5.4 Third-Party Services Disclaimer: Kinnect may provide access to third-party services or links. We are not responsible for third-party content, privacy policies, or service failures. Users engage with third-party services at their own risk.

6. Dispute Resolution

6.1 Mediation First: Any disputes must first be resolved through mediation administered by a mutually agreeable service before arbitration or litigation.

6.2 Governing Law: These Terms are governed by the laws of England and Wales. Any legal disputes shall be resolved within the jurisdiction of English courts.
